E-Commerce

What is e-commerce?

Quite simply E-commerce is the use of telecommunication and computers in order to support trade.

E-commerce is the short for Electronic Commerce. This is a modern term describing the growing on-line economy. Since the internet began, thousands of new companies have come into existence and are trading goods and services electronically. The e-commerce business may be for products sold directly to the consuming public or directly to other businesses. E-Commerce is conducted with low overhead and in most cases without even storefronts.

According to the WTO definition as stated in its Declaration of May 20, 1998, "the term electronic commerce is understood to mean the production, distribution, marketing, sale or delivery of goods and services by electronic means."


How can I set up an e-commerce business in Pakistan?


Currently, there are no laws that apply specifically to the setting up of an e-commerce business in Pakistan. E-commerce is like any other business i.e. you have the options of starting your business as a sole proprietor; a partnership; as a private company limited by shares or a public company limited by shares. Your choice of structure will depend greatly on your business planning, projected feasibility, customers, finances, staff and other resources and the product or service, which is on sale.


Legal Issues with doing Business on the Internet


In any e-business strategy, it is important to address the key legal issues from the start and comprehensively. At a basic level, these are matters such as copyright and libel; at a more advanced level, such things as unique restrictions pertaining to the sale of your product within particular jurisdictions need to be dealt with. If you're starting a business on the Web, there are important legal issues to consider.


Information Technology (IT) Policy of Pakistan


The policy calls for declaring information technology as 'Infrastructure Facility' and frames proper regulation incentives for encouraging venture capital investment and setting up of private funds. This could be monitored and regulated through the establishment of a venture capital industry association. The policy calls for setting up Venture Capital Funds for low-interest loans and investment in equity for companies set up by enterprising and qualified people in software, hardware design and resource development.

There is also a remarkable achievement in infrastructure enhancement as Internet has been expanded from 29 cities to 852 cities with the active participation of Pakistan Telecommunication Company Limited.

A number of programmes for training, creations of awareness, exchange of commercial documents are also under way for the promotion of this vital sector. The required progress has not been made in the banking network and internet banking connectivity. The banks have been very slow and Pakistan is not going to have any genuine e-commerce in Pakistan unless its banks could get their act right. Pakistan plans to start publishing an E-readiness rating of the banks in the near future.


Electronic Transactions Ordinance


AN ORDINANCE

To recognize and facilitate documents, records, information, communications and transactions in electronic form, and to provide for the accreditation of certification service providers.

WHEREAS it is expedient to provide for the recognition and facilitation of documents, records, information, communications and transactions in electronic form, accreditation of certification service providers, and for matters connected therewith and ancillary thereto;

AND WHEREAS the President is satisfied that circumstances exist which render it necessary to take immediate action;

NOW, THEREFORE, in pursuance of the Proclamation of Emergency of the fourteenth day of October, 1999, and the Provisional Constitution Order No. 1 of 1999, read with the Provisional Constitution (Amendment) Order No. 9 of 1999, and in exercise of all powers enabling him in that behalf the President of the Islamic Republic of Pakistan is pleased to make and promulgate the following Ordinance:


Cyber Crimes Act-2003


A Bill

To provide for punishment of the electronic crimes and for matters connected therewith or incidental thereto;

Whereas it is expedient to deter action directed against the confidentiality, integrity and availability of electronic system, networks and data as well as the misuse of such system, networks and data by providing for the punishment of such conduct and providing for sufficient powers to effectively combat such offences by facilitate their detection
